Terms of Service

1. Acceptance of Terms
Welcome to Lythen, an online platform that connects RV travelers with campground owners and facilitates instant booking of campsites ("Service"). These Terms of Service ("Terms") govern your use of our website, mobile application, and related services provided by Lythen, LLC ("Company", "we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Lythen provides an online marketplace that enables users to search, discover, and book campsite accommodations ("Listings") offered by campground owners, operators, and managers ("Hosts"). Users who book accommodations through our platform are referred to as "Guests."
Our Service includes but is not limited to: campsite search and filtering, instant booking capabilities, secure payment processing, guest-host communication tools, review and rating systems, and customer support.
3. User Accounts and Registration
Account Creation: You must register for an account to access certain features of our Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Account Types: We offer separate account types for Guests (travelers seeking accommodations) and Hosts (campground owners/operators). Each account type has specific features and responsibilities as outlined in these Terms.
4. Booking and Payment Terms
Instant Booking: When you make an "Instant Book" reservation, you are entering into a contract directly with the Host. Payment will be processed immediately upon confirmation.
Payment Processing: We act as a payment processor for transactions between Guests and Hosts. All payments are processed securely through our third-party payment providers. We are not responsible for payment processing errors by third-party providers.
Service Fees: We charge service fees to both Guests and Hosts for successful bookings. These fees are clearly disclosed before completing any transaction and are non-refundable except as required by law.
Pricing: Hosts are solely responsible for setting prices for their Listings. Prices may include accommodation fees, cleaning fees, and applicable taxes. Total cost will be displayed before booking confirmation.
5. Cancellation and Refund Policy
Standard Cancellation Policy
Host-Specific Policies: Individual Hosts may set their own cancellation policies, which will be clearly displayed on each Listing. Host policies may be more restrictive than our standard policy but cannot be less restrictive.
Extenuating Circumstances: In cases of severe weather, natural disasters, government-mandated closures, or documented medical emergencies, we may provide full refunds outside the standard policy at our discretion.
Refund Processing: Refunds will be issued to the original payment method within 5-10 business days. Processing fees are non-refundable except in cases of Host cancellation or documented platform errors.
Host Cancellations: If a Host cancels a confirmed booking, the Guest will receive a full refund including all fees, and the Host may be subject to penalties including listing suspension.
6. User Responsibilities
Guest Responsibilities
- • Provide accurate information about party size and RV specifications
- • Respect campground rules and policies
- • Leave campsites in the same condition as found
- • Report any issues or damages immediately
- • Follow check-in/check-out procedures
Host Responsibilities
- • Provide accurate Listing descriptions and photos
- • Maintain campsites in safe, clean condition
- • Honor confirmed reservations
- • Respond promptly to Guest communications
- • Comply with local laws and regulations
7. Prohibited Uses
You may not use our Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair our Service. Prohibited activities include but are not limited to:
- • Creating false or misleading Listings or profiles
- • Circumventing our booking and payment systems
- • Engaging in discriminatory practices
- • Posting inappropriate content or reviews
- • Violating intellectual property rights
- • Using automated systems to access our Service
- • Interfering with other users' use of the Service
8. Intellectual Property Rights
The Service and its original content, features, and functionality are owned by Lythen, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Users retain rights to content they post, but grant us a worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.
9. Limitation of Liability
IMPORTANT: Lythen acts as a platform connecting Guests and Hosts. We do not own, operate, or control any campgrounds or accommodations listed on our Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYTHEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Our total liability for any claim related to the Service shall not exceed the amount paid by you to Lythen in the twelve (12) months preceding the claim.
10. Privacy Policy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.
11. Dispute Resolution
Resolution Process: We encourage users to resolve disputes directly. If direct resolution is not possible, our customer support team is available to mediate disputes between Guests and Hosts.
Binding Arbitration: Any legal dispute arising from these Terms or your use of the Service will be resolved through binding arbitration rather than in court, except for small claims court actions.
Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through prominent notices on our Service. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.
If you do not agree to the modified Terms, you must stop using our Service and may close your account.
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.
You may also terminate your account at any time by contacting our customer support team. Termination does not affect any outstanding booking obligations.
